Helicopter Crashes
Cases involving helicopter crashes have very different considerations than fixed wing aviation accidents. Statutes of repose on helicopter parts have even stronger implications due to the fact that the helicopter and helicopter engine certification are separately regulated. Federal Aviation Association regulations impose stricter useful life limitations on helicopter components, such as rotor blades and other components subject to very high levels of rotational stress.
There is an emergency landing procedure called autorotation. The most common reason for an autorotation is an engine malfunction or failure, however this landing procedure can also be performed in the event of a complete tail rotor failure, the rotor blades are driven solely by the upward flow of air through the rotor. Manufacturers usually claim that a competent pilot should be able to land the helicopter safely using this procedure if the main rotor blades were intact during engine power failure. Autorotation is virtually impossible near power lines or over populated areas, water, and dense forests. In the event of a helicopter crash the pilot’s training and experience are critical issues in determining liability.
The investigation of a helicopter crash is the official function of the NTSB. However they are not required to testify in court because their own regulations prevent them from being called as expert witnesses. Experienced aviation lawyers will ensure that the accident scene is carefully photographed and measured and any determinative factors noted such as scars or fuel trails that will assist in determining angle, speed and altitude. Helicopter aviation experts may be needed to examine the scene and provide expert testimony.
