Aviation Law

Missouri Aviation Law

Aircraft ownership and operation is not only a complex business issue, it also carries with it the potential for high risk and tremendous exposure to liability. Aviation is regulated by various federal agencies, including the Federal Aviation Administration (FAA), the Department of Transportation (DOT), and the National Transportation Safety Board (NSTB), as well as various Missouri statutes.

Because of their concern for aircraft safety, these agencies and government entities continually update information and regulations. Even though it can be difficult to stay current with these ever-changing requirements, doing so can literally mean the difference between life and death. The Missouri aviation attorneys of the Hershewe Law Firm know the importance of keeping up-to-date with aviation law and safety alerts and wants plane owners and pilots to be aware of some important information resources.

As an aircraft owner or pilot, it's your responsibility to be aware of the latest rulings, regulations, warnings, and weather advisories. The FAA provides safety advisories and alerts, airworthiness directives, Traffic Collision Avoidance System (TCAS) safety bulletins, and much more information over the internet. A 24-hour Safety Hotline is available for reporting maintenance concerns, aircraft incidents, suspected unapproved parts, and FAA violations.

The National Business Center, a division of the Department of the Interior, provides aviation safety information as well as accident prevention policy and oversight. The center's Interagency Aviation Accident Prevention Bulletins offer topical information of interest to all aircraft operators. A recent bulletin concerned bird strike avoidance, always a concern to pilots and flight crews, but even more so in light of a USAir flight's forced "landing" in the Hudson River after a bird strike during takeoff. Additional topics include aircraft icing, winter weather safety, and heat-related accidents. The Department of the Interior Aviation Lessons Learned Bulletins highlight safety and accident avoidance recommendations derived from the experience of the Department's own pilots.
